{"id":60017,"date":"2019-10-22T16:14:43","date_gmt":"2019-10-22T14:14:43","guid":{"rendered":"https:\/\/ibars.institucioibars.com\/lacomiadament-contractes-dempleats-la-llar\/"},"modified":"2019-10-22T16:14:43","modified_gmt":"2019-10-22T14:14:43","slug":"lacomiadament-contractes-dempleats-la-llar","status":"publish","type":"post","link":"https:\/\/www.institucioibars.com\/ca\/lacomiadament-contractes-dempleats-la-llar\/","title":{"rendered":"L&#8217;acomiadament en contractes d&#8217;empleats de la llar"},"content":{"rendered":"<h1><span style=\"color: #339966;\">Indemnitzaci\u00f3 en els contractes d&#8217;empleats de la llar<\/span><\/h1>\n<p>Els empleats de la llar tenen els mateixos drets laborals que la resta de treballadors per compte d&#8217;altri. Encara que la seva relaci\u00f3 laboral t\u00e9 algunes caracter\u00edstiques especials regulades en el Reial decret 1620\/2011. Per tant l&#8217;acomiadament en contractes d&#8217;empleats de la llar es regeix a nivell b\u00e0sic segons el que s&#8217;estableix en l&#8217;estatut dels treballadors per\u00f2 t\u00e9 unes particularitats espec\u00edfiques.<\/p>\n<p>La relaci\u00f3 laboral d&#8217;un empleat de la llar amb el seu ocupador pot finalitzar per la majoria de motius establerts en el Art 49 de l&#8217;Estatut dels Treballadors.<\/p>\n<h1><span style=\"color: #339966;\">Causa de finalitzaci\u00f3 de la relaci\u00f3 laboral:<\/span><\/h1>\n<h2><span style=\"color: #339966;\">Finalitzaci\u00f3 de la relaci\u00f3 laboral a iniciativa del treballador\/a:<\/span><\/h2>\n<p><strong>1.- Baixa volunt\u00e0ria<\/strong>: El\/la treballador\/a comunica de manera inequ\u00edvoca la seva intenci\u00f3 de finalitzar la relaci\u00f3 laboral donant-la per conclosa de manera volunt\u00e0ria.<\/p>\n<p>Per a aix\u00f2 haur\u00e0 de realitzar una comunicaci\u00f3 formal per escrit de la seva intenci\u00f3 a l&#8217;ocupador\/a en la qual haur\u00e0 d&#8217;indicar de manera expressa com ser\u00e0 el seu \u00faltim dia de treball.<\/p>\n<p>Per a comunicar una baixa volunt\u00e0ria no \u00e9s obligatori establir uns dies de preav\u00eds previ a l&#8217;ocupador\/a. Tret que aquests hagin quedat pr\u00e8viament pactats en el contracte laboral. En aquest cas, aquest acord obliga a totes dues parts i en aquest cas el treballador\/a ha de complir amb els dies establerts de preav\u00eds.<\/p>\n<p>2.- <strong>No renovaci\u00f3 de contracte<\/strong>: Si arribat el venciment del contracte laboral el treballador\/a no desitja continuar la relaci\u00f3 laboral, malgrat la renovaci\u00f3 oferta per l&#8217;ocupador\/a. Aquesta baixa s&#8217;entendr\u00e0 tamb\u00e9 com una baixa volunt\u00e0ria de la relaci\u00f3 laboral per part del\/la treballador\/a.<\/p>\n<p>En tots dos casos, el treballador\/a tindr\u00e0 dret a la percepci\u00f3 de la quitan\u00e7a per\u00f2 no tindr\u00e0 dret a cap indemnitzaci\u00f3 per part de l&#8217;ocupador\/a.<\/p>\n<h2>\n<span style=\"color: #339966;\">Finalitzaci\u00f3 de la relaci\u00f3 laboral a iniciativa de l&#8217;ocupador\/a <\/span><\/h2>\n<p><strong><span style=\"color: #339966;\">Desistiment <\/span>de l&#8217;ocupador<\/strong>: L&#8217;ocupador\/a pot, sense la necessitat d&#8217;indicar una causa cap, donar per finalitzada la relaci\u00f3 laboral mitjan\u00e7ant el desistiment del contracte.<\/p>\n<p>El desistiment del contracte i per tant la finalitzaci\u00f3 de la relaci\u00f3 laboral obligar\u00e0 l&#8217;ocupador\/a a abonar una indemnitzaci\u00f3 de dotze dies de salari per cada any treballat, amb un l\u00edmit de sis mensualitats.<\/p>\n<p>A m\u00e9s, est\u00e0 obligat a facilitar un preav\u00eds de 20 dies naturals en cas que la relaci\u00f3 laboral superi l&#8217;any de durada, o de set dies en cas contrari.<br \/>\nEl preav\u00eds es podr\u00e0 substituir per un dia de salari per cada dia d&#8217;abs\u00e8ncia de preav\u00eds.<\/p>\n<p>Quan es realitza un desistiment, aquest s&#8217;ha de comunicar expressament per escrit, i s&#8217;ha de posar des d&#8217;aquest dia la <a href=\"http:\/\/www.mitramiss.gob.es\/es\/portada\/serviciohogar\/nueva-regulacion\/extincion-contrato\/index.htm\">indemnitzaci\u00f3 <\/a>a la disposici\u00f3 del treballador\/a.<\/p>\n<p><strong> Acomiadament disciplinari<\/strong>: En cas d&#8217;un incompliment greu i culpable del treballador, el titular de la llar familiar podr\u00e0 extingir la relaci\u00f3 laboral sense dret a una indemnitzaci\u00f3 ni necessitat de preav\u00eds.<\/p>\n<p>Les causes que motivin l&#8217;acomiadament s&#8217;hauran d&#8217;indicar en la carta d&#8217;acomiadament que haur\u00e0 de lliurar-se per escrit al treballador.<\/p>\n<p>Si la relaci\u00f3 laboral s&#8217;extingeix per un acomiadament disciplinari, l&#8217;ocupador haur\u00e0 de seguir tots els passos i demostrar adequadament les causes d&#8217;acomiadament. Ja que de no fer-ho aix\u00ed l&#8217;acomiadament seria improcedent i per tant tindria dret el treballador a una indemnitzaci\u00f3 de 20 dies per any treballat amb el l\u00edmit de sis mensualitats.<\/p>\n<h1>\n<span style=\"color: #339966;\">Causes d&#8217;acomiadament improcedent en el r\u00e8gim d&#8217;empleats de la llar:<\/span><\/h1>\n<p>Si \u00e9s un acomiadament disciplinari: Ser\u00e0 improcedent si l&#8217;ocupador no el notifica per escrit o si les causes d&#8217;acomiadament no s\u00f3n certes o no es poden provar.<\/p>\n<p>En un desistiment de l&#8217;ocupador: Pot ser declarat improcedent si no s&#8217;abona al treballador la indemnitzaci\u00f3 corresponent de manera adequada.<\/p>\n<h2>\n<span style=\"color: #339966;\"><strong>Maneres d&#8217;impugnaci\u00f3 per part del treballador en cas de disconformitat amb l&#8217;acomiadament.<\/strong><\/span><\/h2>\n<p>Quan un desistiment no s&#8217;ha realitzat en forma o un acomiadament \u00e9s considerat per part del treballador com a improcedent, pot reclamar directament a l&#8217;ocupador.<\/p>\n<p>Si l&#8217;ocupador no est\u00e0 conforme, pot continuar la seva reclamaci\u00f3 judicialment. Per a aix\u00f2 disposa d&#8217;un termini de 20 dies h\u00e0bils des de la data d&#8217;efectes de la mesura.<\/p>\n<p>La reclamaci\u00f3 es realitza inicialment mitjan\u00e7ant una conciliaci\u00f3 laboral, i en cas de no arribar a un acord amist\u00f3s, podria emprendre l&#8217;acci\u00f3 judicial.<\/p>\n<p>Aquesta reclamaci\u00f3 no precisa d&#8217;advocat.<\/p>\n<h1><\/h1>\n<h1><span style=\"color: #339966;\">Altres causes de finalitzaci\u00f3 d&#8217;un contracte d&#8217;empleat de llar.<\/span><\/h1>\n<p>\u00a0<\/p>\n<h2><span style=\"color: #339966;\">Si no supera el per\u00edode de prova.<\/span><\/h2>\n<p>En el moment de subscriure un contracte existeix la possibilitat de l&#8217;ocupador de fixar un per\u00edode de prova, en el qual l&#8217;ocupador pot valorar al treballador i al rev\u00e9s.<\/p>\n<p>Durant aquest per\u00edode fixat, tant l&#8217;ocupador com el treballador poden donar per finalitzat el contracte sense necessitat d&#8217;argumentar cap causa. Pel que tampoc hi haur\u00e0 l&#8217;obligaci\u00f3 de pagar indemnitzaci\u00f3.<\/p>\n<p>La forma de comunicaci\u00f3 sempre \u00e9s recomanable realitzar-la per escrit, detallant l&#8217;\u00faltim dia que es prestaran els serveis.<\/p>\n<p>El per\u00edode de prova que de pot fixar en un contracte dep\u00e8n de la durada inicial d&#8217;aquest. Per\u00f2 existeix un m\u00e0xim de dos mesos per a contractes igual o superior en temps a sis mesos. La resta de contractes tindran un per\u00edode de prova m\u00e0xim d&#8217;un mes.<\/p>\n<h2>\n<span style=\"color: #339966;\">Defunci\u00f3 de l&#8217;ocupador<\/span><\/h2>\n<p>Quan la finalitzaci\u00f3 de la relaci\u00f3 laboral ve com a conseq\u00fc\u00e8ncia de la defunci\u00f3 de l&#8217;ocupador. S&#8217;aplica l&#8217;estipulat en l&#8217;estatut dels treballadors. El dret a una indemnitzaci\u00f3 equivalent a un mes de salari. Aquesta indemnitzaci\u00f3 es genera amb independ\u00e8ncia de l&#8217;antiguitat del treballador.<\/p>\n<p>En els casos en qu\u00e8 mori la persona a la qual es presta servei, per\u00f2 el contracte estigui subscrit amb un altre ocupador resident en el domicili, la rescissi\u00f3 de contracte nom\u00e9s es podr\u00e0 realitzar al venciment del mateix o mitjan\u00e7ant un desistiment<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Indemnitzaci\u00f3 en els contractes d&#8217;empleats de la llar Els empleats de la llar tenen els mateixos drets laborals que la resta de treballadors per compte d&#8217;altri.
